General Terms and Conditions of Sale (GTC)

DELIVERY TERMS

Subject to the buyer complying with the provisions of Article 13 below, we assume responsibility for transportation risks, unless the buyer chooses to collect the goods or arranges transport independently. Unless otherwise stated or unless the buyer organizes transport directly, delivery and assembly will be handled by us in a single delivery upon full receipt of the order. Any additional deliveries will be quoted separately and charged to the buyer, unless a partial delivery was explicitly agreed upon in the order form. Delivery is scheduled by appointment, during the carrier’s regular rounds, without guarantee of a fixed date, to the designated site, and in the presence of the buyer or their representative. For apartment installations, ownership is transferred progressively as the work is accepted by the property owner, the architect, or via progress reports — subject to the retention of title clause outlined in Article 16. The buyer is solely responsible if the ordered goods cannot be delivered inside the premises due to space limitations or restricted access — unless this difficulty was clearly stated at the time of order and noted on the purchase order. Otherwise, the goods will be returned to our premises, and the invoice will become immediately payable. The buyer will then be responsible for organizing delivery and assembly at their own expense. Upon delivery, the buyer or their representative must immediately inspect the goods for conformity. Any issues must be clearly noted at the time of delivery. Signing the delivery note without reservation implies full acceptance of the items as compliant. Please note: Furniture delivered may differ from showroom visuals or samples, particularly in color. Natural materials — such as marble, wood, leather, or stone — may show variations, natural markings, or imperfections inherent to their nature. These characteristics do not constitute defects and shall not justify a cancellation or replacement. No claims regarding non-conformity will be accepted after 48 hours from the delivery note signature. Once accepted as compliant and in good condition, goods cannot be returned or exchanged.

PAYMENT

Payment must be made in accordance with the terms agreed upon at the time of ordering. Unless otherwise stated, the remaining balance must be paid in full, without discount, to the delivery person on the day of delivery or by the agreed due date. If the buyer requests partial delivery, payment for the items actually delivered must be made in addition to the deposit, and cannot be postponed until the final delivery. In the case of payment by bill of exchange with a term not exceeding three months from delivery, failure to pay any single installment shall render the total outstanding amount immediately due, by operation of law, eight days after a formal notice is sent by registered letter with acknowledgment of receipt — without the need for further reminder. We also reserve the right to charge any bank fees or interest incurred due to deferred payments. Any payment incident may result in the suspension of current deliveries or services, without prejudice to legal or criminal proceedings.

PRICES

Prices are listed inclusive of all taxes (VAT included), unless otherwise specified, and exclude delivery and installation fees. The price indicated prior to purchase is for reference only. Each sale is conducted based on the Bel Œil pricing in effect on the day the order is placed.

LATE OR NON-PAYMENT

In the event of late payment, penalties will apply automatically and without prior notice. For professional clients, the late payment penalty rate is three times the legal interest rate in force. For private consumers, the applicable rate is the legal rate plus 5 percentage points, in accordance with Article L.441-10 of the French Commercial Code. In addition, professional buyers are liable for a fixed recovery fee of €40, also under Article L.441-10. Further recovery costs may be charged if proven with supporting documents.

ECO-MOBILIER

Bel Œil is registered with the French National Register of Furniture Producers under number FR016588_101YTS. This registration confirms our compliance with regulatory obligations set forth in Article L.541-10-1, paragraph 10° of the French Environmental Code, through our membership in Eco-Mobilier.

CLAIMS

The buyer or their representative must inspect the goods at the time of delivery. In case of transport-related damage, any reservations must be noted clearly on the delivery slip. Additionally, the buyer must notify the carrier of any visible damage or missing items by registered letter within three calendar days (excluding public holidays) following receipt of the goods. A copy of this letter must also be sent to us by email. Failure to follow this procedure may forfeit our ability to file a claim with the carrier, in which case the buyer alone will bear the consequences. If the product does not conform to the order or presents an apparent defect, the buyer must notify the seller within 24 hours of delivery (excluding Sundays and public holidays). Failure to do so will result in the forfeiture of the right to claim. Bel Œil cannot be held liable for damage caused by the buyer’s mishandling or misuse. In the event of a conformity issue, the buyer must refrain from intervening on the product in any way. Any alteration may result in loss of the right to claim.

WARRANTY

Our commercial warranty is limited to 18 months from the delivery date. It applies only under normal use and conditions, and only if the claim is made by registered letter with acknowledgment of receipt. The warranty excludes: • Handling errors • Negligence or lack of maintenance • Exposure to heat or excessive humidity • Any deterioration caused by external factors unrelated to the furniture’s intrinsic qualities. Also excluded are damages resulting from normal wear and tear, or from assembly/disassembly carried out by the buyer or a third party. However, we fully honor the legal warranty against hidden defects as set out by French law, with no time limitation, provided such defects are reported as soon as they are discovered. Claims related to visible defects, execution errors, non-conformity, or any other apparent anomaly must be submitted by registered letter within 48 hours of delivery. Under the terms of this warranty, Bel Œil undertakes only to replace defective parts in its own workshop. Labor costs remain the buyer’s responsibility. No sale cancellation, price reduction, or compensation may be claimed. No warranty will be granted if the buyer fails to pay for the goods in accordance with the agreed terms. Please note: Finishes may change in color over time due to exposure to light, aging, or other external factors. When reordering additional items, color variations shall not be grounds for refusal or claim.

RETURNS

No merchandise may be returned without our prior written consent and without compliance with our return instructions. Any return request — whether for an exchange or store credit — must be submitted within 8 days of purchase and accompanied by the original invoice. Such a request will only be accepted if authorized in writing by Bel Œil and if the items are returned in their original condition and packaging. Custom-ordered products cannot be returned or exchanged under any circumstances. Items sold as part of special promotions or clearance sales are considered final and are not eligible for return or exchange. In accordance with Article L.221-18 of the French Consumer Code, the right of withdrawal does not apply to purchases made in physical retail stores.
